Confederation decides to go for nationwide indefinite strike in the month of June,2014

CONFEDERATION DECIDES TO GO FOR NATIONWIDE INDEFINITE STRIKE IN THE MONTH OF JUNE, 2014.

To protest against the total neglect and negative attitude of Central Government in the Budget towards Central Government employees.

Dear Comrade,
The National Secretariat met today.  It reviewed the strike participation on the basis of the reports received from the States and the affiliates.  The meeting noted with appreciation the efforts undertaken by the affiliates and the State leaders in making the stake a grand success.  On the basis of the deliberations, the meeting adopted the enclosed resolution and took the following decisions.
1. To organise 48 hour Dharna on 24th and 25th Feb. 2014 at Delhi against the  attitude of the finance Minister in not conceding the demand for Interim relief and merger of DA etc. , while presenting the Vote on Account. The National leaders along with the active workers of Delhi will participate in the programme.
2. To organise a National Convention at Nagpur on 4th April, 2014 from 11 AM to 5 PM to mobilise the    employees for the task for accomplishment detailed in the enclosed resolution, especially in    the coming general election.
3. The State Committees will organise such conventions in all State Capitals for the same purpose.
4. Campaign meetings will be organised in front of all Central Government offices, where the District level and State level leaders will detail the decisions taken by the National Secretariat.
5. The Confederation National Secretariat will meet in May 2014 and decide upon the indefinite strike      action in pursuance of the 15 point charter of demands to be organised in June, 2014.
6. The Tamilnadu State Committee will be requested to explore the possibilities of organising campaign against Shri P. Chidambaram, Finance Minister in the Constituency from where he would seek election to the Lok Sabha.

 

7. The State Committees will make arrangements for translating the resolution in vernacular and circulate amongst the mass of the employees.

DRAFT RESOLUTION

            The National Secretariat of the Confederation places on record its appreciation and gratitude over the massive and magnificent participation of the largest number of our members in the 48 hour strike on 12thand 13th Feb. 2014.  It was a great manifestation of the confidence,  the members  had reposed in the organization and their determination to win the demands through struggles.  The reports, the Confederation CHQ received both  from the affiliates and the State Committees indicate the massive participation of the employees in the strike action throughout the county.  In some of the affiliates, the participation had been cent percent.  This must embolden the Confederation to pursue the issue with determination and organize further action programmes to ensure that the demands are got settled.
            
The Secretariat has noted that the Government  had pretended to ignore the massive action of the employees.  There had been no response from them so far.  In the wake of the strike action, it announced the composition of the 7th CPC disregarding the united demand raised by the Staff side of the JCM National Council for the inclusion of a labour representative.  The Government also chose not to convene the meeting the staff side to discuss the draft terms of reference submitted,.  It did not make any announcement on the question of merger of DA, Interim Relief, inclusion of GDS within the ambit of the Commission and rejected the demand for making the recommendation of the Commission effective from 1.1.2014. 
            
On every issue, which is included in the 15 point Charter of demands, the Govt. continued with its nugatory attitude.   In the last session of the Parliament, they ensured that the PFRDA bill becomes an Act despite the strongest objection and resistance of the employees by eliciting and receiving the support and patronage of the dominant opposition party, the BJP.  Even on comparatively smaller issues like compassionate appointments, no positive response emerged.   The period witnessed increased outsourcing of governmental functions.  Almost a third of the workforce is presently casual and contract workers with abysmally poor wages taking advantage of the acute unemployment situation in the country.  There had been no settlement of any issue raised by the Staff Side in the National Council JCM.  In fact no meeting of the council was convened and no issue discussed or settled during this period.
            
The plight of the three lakh Gramin Dak Sewaks of the Postal Department is highly deplorable.  They constitute almost half of the Postal workforce. But for them, the functioning of the Postal system will come to a grinding halt.  Their service conditions are presently worse off than even a causal/daily rated worker. Despite the Supreme Court’s decisions that they are holders of Civil Posts and consequently are entitled to the benefits and privileges of a civil servant, there had been no improvement in their service conditions worth mentioning.  In spite of repeated presentation of their case both inside and outside the Parliament by people from all walks of life irrespective of party affiliation, the Government had been silent to the pleading for bringing them within the ambit of the Pay Commissions.  Confederation is duty bound and determined to change the situation and to bring them within the purview of the 7th CPC.
 
            During its five year tenure, the UPA II was in power, it intensified the neo-liberal reforms, phased out all welfare measures introduced to benefit the poor by the previous Governments; accentuated the unemployment situation by various job killing devices; divested the PSUs; allowed unbridled entry of Foreign capital to subjugate the Indian people; ruined the indigenous industry, destroyed the livelihood of the farmers and agricultural labourers, allowed the prices of all essential food items to soar, privatised education and health care services, ensured that each of its decision was to favour the rich, granted huge tax concessions to the corporate, indulged in large scale corruption, squandered away the national wealth, siphoned off the poor man’s earning into the hands of a few rich in the country, sided with the entrepreneurs in all labour disputes,  took each and every political decision to sub-serve the interest of the imperialist powers, especially the USA.  The pursuance of the neo liberal policies at the behest of the advanced capitalist countries drove the majority of Indian population to be below the poverty levels. In the comity of nations, our country became the poorest and the last ranking in all fields. Our youth were driven to be beggars at the doors of transnational corporations and developed countries.

            Those who were responsible in driving our country men to unprecedented deprivation has to now seek mandate, for their tenure is to end shortly.  No different is the approach of the major opposition party, BJP.  There is nothing to chose from these two political dispensations.  They were hand in glove together to demolish the sovereignty of the country; pauperisation of the people and supported every legislation to intensify the neo liberal exploitation of the common people.  They supported to the hilt the corporate houses.  But for the support extended by the BJP, the PFRDA would never have been made into a law.  The Act now provides for the extension of the new contributory pension scheme to those who were recruited prior to 1.1.2004 and the existing pensioners.  Despite the refusal of the Government to accept their suggestion to guarantee minimum pension, the BJP unashamedly supported the Bill, for they were the proponents of the neo liberal economic policies.  They supported this Government to increase the FDI and FII in all sectors of economy and announced that they would intensify the reform process if elected to power.  The conglomeration of Corporate in the country has now appointed the leader of that party to be the next CEO to run the country.  They have no use for the discredited UPA howsoever subservient it could be.  They know in a democratic system demagogy can play a vital role.  They are certain that BJP and its allies if elected to power will be much more pliant and compliant.

            It is in this background that the workers must assess the political situation.  In the forthcoming electoral battle, every worker must discharge their salutary responsibility.  Since the present state of affairs is the product of the neo liberal policies and since both the UPA and the NDA are the proponents of those policies, he/she must have clear vision and exercise the franchise effectively to ensure that a pro worker, pro people combination of parties is in governance.  He/she must discharge that responsibility for his/her own sake and for the sake of this great nation. 

            The Secretariat came to the inescapable conclusion that the settlement of the demands in the charter will only be possible through intensification of the struggles.  It recognised the need for larger unity. It will strive for bringing about such a united platform for joint action.  The inevitability of an indefinite strike action has to be emphasised.  The Confederation and its affiliates must prepare its members for such an eventual and unavoidable action, if the proposed 7th CPC is to really revise the wages.  It is needed to ensure the withdrawal of the pernicious contributory pension scheme.  It only will ensure that there are no casual or contract system of employment in Government service.   The Government employees must be bestowed with democratic rights and above all must enjoy the facility for collective bargaining and right to strike.  The Gramin Dak Sewak system is a colonial legacy and no civilised country must endure such brutal exploitation.  All is possible through united and sustained action.  The Confederation has proved beyond any iota of doubt that it has built up an organisation capable of carrying out such an action.  Such action must be planned to take place after the electoral battle is over.  Every active worker of the Confederation must fan out and reach out the rank and file of the workers.  Since the task is stupendous, the endeavour and effort must also be equally persisting.

            The meeting of the National Secretariat of the Confederation has decided to call upon all its affiliates, the State Committees, District Committees and units to work in consonance with the understanding depicted in this resolution; mobilise the rank and file for the eventual indefinite strike action in June, 2014 and strive to bring about a revolutionary change in the governance of our polity.

Dear Comrade,

               We thank you very much for the great efforts undertaken by all of you in carrying out the month long agitation of non-co-operation action against the nugatory attitude of CBDT in settlement our long pending demands. We were informed by our circle secretaries of the tremendous participation of our members in the black flag demonstrations and walk out organised at the time of visit of the Board authorities to the State capitals and elsewhere. These actions had its salutary impact even though some of our circle could not carry out the programme as effectively as others.

            The undersigned along with Com. President had met chairperson and Member(P&V) today. In the matter of allocation of posts, the Chairperson informed us that the internal discussions in the Board are yet to reach finality.  She has indicated that the said discussions might be concluded during the next week, where after, the issue will be subjected to discussion with ITEF  to reach an amicably agreed proposition.

In view of the directions of DOPT to refer the clarifications on implementation of Supreme Court Order in Union of India & Ors vs. N.R.Parmar & Ors. to Law Ministry for their approval, the Board has decided to keep the earlier instruction in abeyance.   Also since the CAT principal Bench has stayed the Board’s order stopping payment to daily rated workers, the Board will issue appropriate orders in the matter.

In the light of above discussions and conclusions we may advise you to suspend the ongoing non-co-operation movement for the time being but be prepared to recommence the same at short notice.

ITEF MEMBERS AGAIN CREATED HISTORY BY UNPRECEDENTED PARTICIPATION IN THE TWO DAY STRIKE OF 12TH AND 13TH FEB. 2014.

The ITEF Central headquarters warmly congratulate the Leaders of the Circles, Branches and Members who have made the two-day general strike on February 12th and 13th a magnificent success. The reports received by the Central Headquarters of Income Tax Employees Federation indicated cent percentage participation of the employees in the two-day strike making it a historic one.  In all the Circles the strike was 100 percent success. The only exception to this and for the first time is the non-implementation of the call by the ITEF Western UP (Kanpur Circle). The reports received by the Circle General Secretaries from the branches were collated, and we are proud to inform that in many stations even Officers either did not come to office or preferred to return after seeing the total strike by the employees.  In Kerala the entire members of ITGOA were on mass casual leave  for the two days in support and solidarity with the striking employees.  In Tamilnadu, the members of the Income Tax Pensioners Federation held a massive demonstration in front of Aayakar Bhawan and also in front of the GPO.   Invariably in all places the Casual/contract workers and contingent paid employees either remained absent or joined the striking employees making virtual closure of offices in many places.

             The strike call given by the Confederation of Central Government Employees and Workers against the attitude of the Government in settling our issues indeed  highlighted the anger and anguish of the Government Employees.  The Central Govt. employees under the confederation demanded the date of effect of the 7th Central Pay Commission for wage revision from 01.01.2014, Merger of DA for all purposes, Grant of Interim Relief, Removal of conditions on compassionate ground appointment, Raising the Bonus ceiling, Stoppage of outsourcing of Governmental functions, Contractorisation, privatisation etc. Regularisation of Grameen Dak Sewaks, contingent, casual and daily rated workers, lifting the ban on creation of posts, filling up the vacant posts, Revival of the negotiating forum, JCM etc. The anger and anguish of the Government Employees was demonstrated with massive and larger participation across the country and Departments, than past industrial actions in spite of its longevity of 48 hours.  We are sure, no Government of sensitivity can ignore the anger of itds employees demonstrated during the two days and will have to reconsider its stand on various demands raised by them.

            We place our gratitude to the leaders of all the Circles of ITEF  for  the great efforts taken by them in reaching out to the rank and file of the membership.  The massive preparation made by them and the efforts taken by the branch/unit level leaders has resulted in the historic success and making a glorious chapter in the History of ITEF.

Foundation Day message of ITEF President

PRESIDENT’S MESSAGE
ON THE EVE OF THE 62ND FOUNDATION DAY OF ITEF.

As in February 2013, this year too, our Federation day is to be followed by a 48 hour strike action at the call of the Confederation of Central Government employees and workers. The 12th December, 2012 one day strike action in which cent per cent of the ITEF members took part generated the sanctions which compelled the Government to announce in September, 2013 the setting up of the 7th CPC. The UPA Government must have expected the CGEs to be euphoric over the announcement and thus make political gains in the following legislative assembly elections of various States . The employees rightly recognising the post dated cheque ensured that the party in power realises the reward for chicanery. On 12th December, 2012 the dominant organisations of both Railways and Defence stayed away from action. When the issue and the strike action gained momentum the leadership of those organisations decided to seek the mandate of the common workers through an opinion poll. The response of the common Railway workers was magnificent. They voted overwhelmingly for strike action for they know that without which the wage revision of Central Government employees with a periodicity of five years as is the case with the public and private sector workers would not come about. A joint movement of the entirety of Central Government employees was the expectation but did not emerge. The reluctance to tread the path of struggle was writ at large. Confederation having realised that the joint movement having turned into a mirage decided to call upon its members to organise 48 hour strike on 12th and 13th February, 2014 when both the Railway and Defence workers will again be (unfortunately) spectators.

The last five years, the UPA II was in power was the period the neo- liberal economic policies were operated at its peak. The common people of our country was at the receiving end of the pernicious policy . Incessant rise in the prices of all commodities, unbridled inflation, rising unemployment, deprivation, penury and poverty, the withdrawal of welfare measures introduced earlier to provide succour to the working people one by one were its hallmark. The people responded to every call for struggle directed against the economic policies, be it from the Trade Unions or of the political parties.. The united platform of Trade Unions which spearheaded the resistance movement against the neo-liberal policies grew in size and stature. In the State elections held in November/December, the people voted decisively to defeat the Indian National Congress which leads the political outfit called UPA.

Back home at our departmental level, I am afraid that the fabric of unity we assiduously built over the years with toils and sacrifices is on the verge of terrific tension. Most of us are saddened over the developments over the issue of allocation of the additional posts created on account of the cadre restructuring and review. We were the first to have the cadre review exercise completed and get the nod of the Government (after the 6th CPC) for creation of over 20,000 posts. It was the result and reflection of our unity and strength manifested magnificently on several occasions, especially during the general strike actions of the workers in the country. We sat hours together, deliberated in detail, consciously compromised to arrive at a consensus. We must ensure that the consensus so reached unanimously prevails. We cannot afford to lose our unity except at our peril. We must come out of the piquant situation that has been engineered to demolish and destroy us.

Viewed from that perspective, the 12th and 13th February strike provides us with a fine opportunity to rekindle the spirit of unity and prove that the capacity to struggle alone make an organisation strong. We are called upon to establish that, despite difficulties created by canard, half- truths and blatant lies, we will stand united and ITEF shall remain the most militant trade union organisation.

I appeal to every one of you on this solemn occasion of the 62nd foundation day of our Federation to uphold the spirit of unity and struggle and march into a better and brighter tomorrow.

Sub: Meeting with Member Personnel on 16th and 17th January, 2014 on Cadre Restructuring-

As intimated in our last circular a meeting was convened by the Member (P&V),CBDT with the representatives of ITEF and ITGOA on 16th and 17th January, 2014 to discuss the report of the Core Committee on allocation of posts. The meeting was chaired by Ms. Deepak Krishan, Member (P&V) and attended by Shri S.K. Lohani’JS (Admn), Shri Debjyoti Das, Director of IT (HRD) and Ms. Swati Joshi, Addl. DIT(HRD) from the Official side. Following ITEF representatives presented our views on various issues. Coms. Ashok B Salunkhe (President), KP Rajagopal (Secy. General), Ashok Kr. Kanojia (Addl. Secy), Raveendran B Nair, Yashwant Purohit (Jt. Secretaries) & Rupak Sarkar (Finance Secretary. The discussion mainly cantered around the different yardsticks adopted by the Sub-Committee No. 1 and core committee and that of the ITEF. Further the stand taken by the Sub-Committee to consider the entire sanctioned strength (Existing SS and Addl. Post sanctioned by the Government) for determining the allocation. Thirdly, the modification carried out by the Core Committee. There was unanimity in both sides that the decision of the Union Cabinet and mandate of the Sub-committee and Core Committee were only with regard to the additionally sanctioned post. Though the broad yardsticks adopted by ITEF and the Official Committee were similar viz. Work load, Revenue Collection, Stagnation and Geographical area, the percentage and basis adopted to formulate the entitlement were different. The representatives also put forth to the authorities that we are inclined to have minor adjustments in the percentage adopted if the authorities divulge their stand, and ready to work out the allocation after carrying out required adjustments with regard to major changes taken place after the 2001 cadre restructuring. We have also emphasised our stands with regard to the Directorates of Delhi, Shifting CIT Charge of Haldwani, CCA for Chhattisgarh, abnormal stagnation in certain charges etc. The meeting was concluded with the assurances of the Member (P&V) to discuss the outcome in the Board meeting and reverting back to us at the earliest. From the nature and outcome of the discussion, we hope that sooner than later an understanding can be arrived in the matter and the process of allocation started without further delay. Undoubtedly the allocation of posts is not the only issue requiring urgent action and immediate resolution by the authorities. The issues like Clear cut instruction as to how the Inter-se seniority is to be fixed as per Supreme Court order, Reversal of the instructions on Casual Labours, Implementation of already approved projects like lap tops to Inspectors, Increased Local Travel expenses to ITI/NS, Mobile handsets, Incremental benefit on promotion, advance increment to STA/Stgr., 6 Air-conditioners per range for staff etc.etc. are still pending. It is in this background the extended Secretariat Meeting arrived at the decision to step into the path of agitation. Therefore, all the Circles are requested to carry out the programme of agitation outlined in the Circular No. 37 dated 14.01.2014 from 21st February, 2014.

Nationwide two day strike by Central Govt. Employees.

As intimated, the Central Govt. Employees are embarking on a two day strike on 12th and 13th February, 2014 on the call of the Confederation of Central Govt. Employees and Workers. The extended Secretariat Meeting of the ITEF on 13.01.2014 decided to call upon all circles to make the strike in Income Tax Department a total success and to put all efforts for the same. The importance of the time selected for the action and issues on which the employees are going on strike need no emphasis, yet these have been detailed in our Circular No. 27 and the Circular of the Confederation enclosed therewith. Further, the Resolution adopted in the National Executive Meeting of the Confederation and the Press Statement issued are also enclosed herewith to enable you a proper and effective campaign. All Circles are requested to put all their efforts for campaign and mobilisation by educating the mass on the significance of the strike and the need to make it glorious. Confederation has put the model Poster in its website (www.confederationhq.blogspot.com) to be used on this occasion. The Circles either under State COCs or independently make wide publicity about the two day strike. The ITEF CHQ (on the Central Board of Direct Taxes) and all other affiliated organisations (on the Departmental Heads), will serve the strike notice on 21st January 2014, as decided by the Confederation. All Circle General Secretaries are requested to intimate their respective Cadre Controlling Authorities about the strike on the same day after a general meeting/demonstration during lunch recess. The copy of the strike notice which CHQ will be serving on the CBDT and model intimation letter to the CCAs are enclosed.

Twelve lakh Central Government Employees will be on 48 hr. Strike on 12th and 13th Feb. 2014 demanding settlement of 15 point charter of Demands, the major issues being immediate wage revision and repealing the new contributory Pension Scheme by reintroducing the Statutory Defined Benefit Pension Scheme which was in vogue for more than a century. The Government in September 2013 announced the setting up of VII-Central Pay Commission to effect Wage Revision from 1.01.2016.
 The employees have made it clear that prospective date of effect is not acceptable to them and the VII-CPC recommendations must of effective from 01.01.2014. The Government is yet to take a decision on the Terms of Reference of the VII-CPC viz, the merger of Dearness Allowance, composition of the VII-CPC with a labour representative, Interim Relief, the need to bring the Gramin Dak Sevaks of Postal Department within the ambit of the CPC.etc. 
The employees are agitated over the introduction of the New Pension Scheme, passing the PFRDA Bill in the last session of the Parliament, the denial to guarantee minimum pension and the provision of the new enactment to cover even the existing employees in the new contributory pension Scheme. The employees covered under the new pension scheme are apprehensive of having no pension at the end of their service career of 35 years for the return on their contributions is presently linked to the market. 
The Confederation of the Central Government Employees and Workers in their National Executive Meeting held at New Delhi on 10th January, 2014 expressed their total dissatisfaction over the closure of JCM, the negotiating machinery and the consequent non-settlement of any of their demands in the last nine years, The introduction of contract labour system in carrying Governmental functions, the indiscriminate outsourcing, closure of many institutions, the total ban on creation of posts and recruitment have made regular employment in Central Services impossible.
The Confederation has therefore, decided to organise the two day strike on 12th and 13th February, 2014. The resolution adopted at the meeting of the National Executive (copy of which is enclosed), explains in detail the major issues.

Secretariat Meeting & decisions:

            The extended Sect meeting was held, as scheduled, on 13th Jan. 2014 at Manishinath Bhawan.  Apart from Secretariat Members, the Advisory Committee Members and Circle General Secretaries who are not members of the Secretariat were also present. The following decisions were taken.

  1. Discussion on the reports of various sub-committees for implementation of the Cadre Restructuring and to decide our approach.

The President and Secretary General in their initial remarks presented the scenario prevailing in various circles after the submission of the report of the Sub-Committee No. 1 (allocation of posts and jurisdiction) and appealed to all that the paramount concern should be our unity.  The house was told the reason for vast difference in the allocations made by the Sub-Committee and that  adopted and presented by the ITEF.  The main reasons for the same were identified as (i) allocation of the posts on the basis of total sanctioned strength instead of allocation of additional posts sanctioned by the Govt. (ii) adoption of unrealistic yardsticks and (iii) total rejection of the parameters suggested by ITEF.  After detailed discussion it was decided to pursue the proposal on the basis adopted by the  Central Working Committee with necessary changes to the extent of issues pointed out by various circles and decided in the CWC meeting.

            The meeting also deliberated in detail the dilly dallying attitude of the CBDT in solving the situation created by the issuance of the instructions dated 15.10.2013 in respect of implementation of Supreme Court order on inter-se seniority, and instructions dated 13.5.2013 for stop payment to daily wage/casual workers etc.  Taking into consideration the above situation and non-settlement and implementation of other issues pending with the Board for quite long time, the house came to the conclusion that no option is left out other than embarking upon serious agitational programme.  According it was decided to launch the following agitational programme, on the under mentioned issues.

  1. To settle the issues arising out of the Sub-Committees reports on Cadre restructuring proposal after discussion with the Representatives of ITEF and immediate implementation thereafter.
  2. Immediate withdrawal of the instruction dated 15.10.2013 in the inter-se seniority matter and issuance of  clear & unambiguous instructions to implement the Supreme Court order in the matter, and
  3. Withdrawal of the instructions to stop payment to Casual/daily paid workers on the basis of the stay granted by the Principal Bench of CA Tribunal and sanction of funds for payment of wages to these workers.

The Secretariat decided to call upon all circle to implement the following agitaional programme to bring about necessary sanction on the CBDT authorities to settle the above and other pending issues immediately.

  1. Mass Dharna on 21.01.2014 at all stations where Chief Commissioners Offices are located.  (in multi CCIT Stations the Dharna may be carried out in front of the Main Office).
  2. Non-Co-operation in the following areas 22.01.2014.

a)     Search & Survey Operations.

b)     Not to submit any kind of statistical reports

c)     Not to attend/work on holidays and after office hours

  1. Black Flag demonstration against  Chairperson and Members of Central Board of Direct Taxes on their visit to any station and walk out from office on that day.

The Secretariat also decided to implement with full success the decision of the Confederation to go for a  two days strike on 12 and 13th February,2014 on the Demands related to Setting up of VII Pay Commission and other demands contained in the 15 point Charter of Demands.  The circumstances under which the Confederation has decided to embark upon on the strike action, Charter of Demands and Campaign programme of Confederation is contained in the enclosed Circular No.11  Dated 12.01.2014 of the Confederation     The Secretariat called upon all concerned to take all necessary steps required to make the strike total and a historic one.   The Circle General Secretaries are requested to present the copy of the strike notice to the Head of Offices after holding massive demonstration on 21.01.2014.

The Secretariat also decided to seek legal recourse on the following two demands rejected by the Government and authorised the CHQ to take necessary steps in the matter including raising funds for the same.

  1. Extension of Pay Fixation formula allowed to CSS/CSSS services to  Inspectors/ AOs/PSs in the Income Tax Department  who are promoted between 1.1.2006 and 30.8.2008 and opted to the Revised pay from the date of promotion.
  2. Inequality in the initial pay of Promotees and Direct Recruitees.

NOTE:  After conclusion of the Secretariat meeting, we have received intimation from the CBDT that the Member (P & V) will hold discussion with ITEF and ITGOA on 16th and 17th January, 2014 on the report of the Core Committee on Implementation of Cadre Restructuring.  The Progress and outcome of the meeting and stand of the CHQ will be intimated.  All are requested to prepare for the agitation as outlined above.

            Sub:     Delay in Implementation of Cadre Restructuring and other matters-

The Secretariat of this Federation with the Circle General Secretaries met at New Delhi on 13.01.2014.  The Meeting considered the situation prevailing in the Department, due to the delay in settling the variations in the formulation & suggestions of various sub-committees,Implementation of the Cadre Restructuring, the confusion and chaos created by the instructions dated 15.10.2013 issued by the CBDT for implementation of the Supreme Court order on inter-se seniority and the plight of the poor casual employees working in the department for years together due to stoppage of wages on instructions from the CBDT.  The Secretariat also took note of the  attitude of the CBDT in not honouring the assurances laid out on the two issues of Inter-se seniority and Casual Labours wages.    It also seriously took note of the total rejection of the formula suggested by this Federation for allocation of posts by the Sub Committee No. 1.

The meeting, therefore, came to the inescapable and unavoidable conclusion that settlement of the long pending issues and for a just and equitable allocation of  the additional posts created through Cadre Restructuring requires agitations.  It has therefore, decided to embark upon a series of progamme commencing with a dharna in front of all CCIT Offices on 21st January, 2014 to be followed by non cooperation in Search & Seizure operations, non-submission of statistical reports etc.

We therefore, request you to kindly commence negotiation on allocation of posts and other relevant issues connected with the Cadre Restructuring and issue instructions in the matter of inter-se seniority for implementation of the Supreme Court judgement and effect stay on the arbitrary orders issued by the Board in the matter of Daily paid/casual workers.

Dear Comrades,

Confederation declared 48 hours nationwide strike of Central Government Employees on 12th &13th February 2014 demanding settlement of 15 point Charter of Demands including DA Merger, Interim Relief, Inclusion of Gramin Dak Sewaks in 7th CPC, Regularization & Revision of wages for casual labourers, Date of effect of 7th CPC as 01.01.2014. Rescind the PFRDA Act etc.

Start campaign and preparation now onwards. Each Affiliated organization should issue separate circulars to all the State and District units and conduct Department wise campaign. Strike notice should be served by each organization to their Head of the department.

MAKE THIS STRIKE A THUNDERING SUCCESS

MASS DHARNA AT JANTAR  MANTAR, NEW DELHI on 9th JANUARY, 2014

In culmination of the first phase of our agitation programme a mass dharna was organized at Jantar Mantar, New Delhi on 9th January, 2014 in pursuance of the 15 point charter of demands.   As per the decision of the National Secretariat, all Secretariat members along with the leaders and workers of Delhi State was to take part in the Dharna.  However, quite a number of comrades from various other parts of the country volunteered to participate in the programme, despite the chilling weather conditions of Delhi, which reflected the growing determination of the rank and file of the workers to fight for the demands and to win the same. Com. K. K. N. Kutty National President presided. The Dharna was inaugurated by Com. S. K. Vyas,  Adviser, Confederation which preceded by a welcome speech delivered by Com. Vrighu Bhattacharya, Secretary, Delhi State Committee.  Leaders of almost all major affiliates of the Confederation and other Secretariat. Members addressed the participants.  Com. A.K. Padmanabhan, President, CITU while greeting the participants in the Dharna, stressed the need for a long and sustained struggle to win the demand. While concluding and congratulating the participants for the large turnout, Com. Secretary General said that a meeting of the National Executive of the Confederation is scheduled to meet on the next day.  He added that National Executive will evaluate the developments of the last few months and will decide upon the date of commencement of the impending strike action. The Dharna programme which was commenced at 11.00 AM was concluded at 3.00 PM, when Com. Parashar on behalf of the National Secretariat. Thanked the participants and the Delhi State Committee.

National Sectt. Meeting on 9.1.2014

The Secretariat Members who took part in the Dharna programme met in an emergent meeting at 5.00 PM to finalise the proposal to be presented to the extended meeting of the National Executive the next day.  Com. Vyas narrated the efforts undertaken by him and the President to interact with the leaders of the AIRF and AIDEF to bring about a common approach both in the matter of 7thCPC and other issues in the charter.  When the Staff Side of the National Council met to finalize draft terms of reference, there had been few takers for the five year wage revision proposed by the Confederation.  He explained as to how the Confederation representatives had to agree with a compromise formula for the date of effect being 1.1.2014 (instead of 1.1.2011), with the clear understanding that the question of periodicity of wage revision of Central Government Employees must be a matter of contention before the 7th CPC.  Despite the overwhelming response from the Railway workers, (more than 90% is reported to have voted in favour of strike in the strike ballot conducted by AIRF) Com. Vyas said that the leaders of the Railway Federation have not indicated their willingness to pursue the demands with a strike action.  The Defence Federation leaders have also indicated that it would be difficult for them to pursue the issues with strike action, unless the same is organized under the auspices of a joint platform of all Federations of Central Government employees.

In the deliberations that followed the introductory remark of Com. Vyas, the following points emerged:

(a)   The announcement of the setting up of 7th CPC by the UPA Government was to be considered as a ploy to obtain electoral mileage;

(b)        The compulsion has been brought about by the Confederation through sustained struggles including the one day (12.12.2012) strike action.

(c)   The need for organizing strike action before the commencement of the election process

(d)        The leaders of the Confederation might make another attempt with the Railway and Defense Federations before the National Executive meeting.

(e)        The possibility of inordinate delay in the setting up of the 7th CPC if not done before elections notified

(f)    Apprehension was expressed by the participating comrades that the Government might go ahead and issues the requisite notification without taking into account the view points of the Staff Side contained in the draft terms of reference submitted.

The meeting, therefore, came to the conclusion that (a) the strike action is the need of the hour and must be organized before the election process commences; (b) the indefinite strike for which  the Secretariat had earlier taken decision must be attempted under the auspices of the joint platform of all Central Government Employees organizations; (c) the Secretary  General might make a proposal for two days strike in the first fortnight of the February for the consideration of the National Executive.(d) A few comrades were of the view that in view of the paucity of time for campaign etc, the proposed strike action might be in the last week of February; (e) fear of the election code of conduct coming into operation immediately after the Parliament session was also expressed by some comrades at the meeting.

The Secretariat authorized the Secretary General to present the proposal for two days strike in the first fortnight of February 2014 to the extended meeting of the National Executive.

Extended meeting of the National Executive and decisions – 10.1.2014

The extended meeting of the National Executive was held at MP Club, North Avenue, New Delhi on 10.1.2014.  In the inaugural address, Com. S. K. Vyas, Advisor briefly placed the developments after the announcement of the setting up of the 7th CPC by the Government.  He particularly referred to the electoral reverses of the UPA in the five State Assembly elections held in November/December, 2013. He considered the electoral reverses as an expression of anger of the common man against the policies pursued by the UPA-II Government. He advised the members to take note of the inescapable conclusion emanating from the election result that the common man given an opportunity will throw out the perpetrators of injustice and anger agony on them.  According to him, whoever follows the neo liberal policies are bound to be the victim of the ire of the working people.

He then narrated the course of discussions on the terms of reference both at the Staff Side meeting as also at the official meeting chaired by the Secretary Personnel.  In his opinion, the Government may not accept any of the suggestions made by the Staff Side unless it is backed up by sustained struggles. The very announcement of the Pay Commission itself was due to the compulsion brought about by the Confederation and its affiliates through struggles.  He reminded the comrades that the Government had consistently refused to meet in the JCM at the National and Departmental levels. The negotiating machinery has almost been closed down.  He said that whenever the meeting takes place, it was with a clear view to defer decisions on the legitimate demands of the employees.  He also explained the efforts undertaken by the Confederation leaders to bring about a united platform of all organizations participating in the JCM in the background of the nugatory attitude of the Government and its failure.  He added that in the given circumstances, hoping for the emergence of a joint platform would be a grave mistake and the Confederation as had been its historical approach, must pursue the charter of demands, which include the setting up of the 7th CPC, through a strike action.

Com. Secretary General presented the proposal emerged at the meeting of the Secretariat a day before, i.e. on 9th and the various viewpoints that came up for consideration at the meeting.  While presenting the proposal he asserted that the announcement of the 7th CPC has come about only on account of the initiative taken by the Confederation. He recalled how the Confederation leaders were ridiculed in 2011 when the demand for the 7th CPC and five yearly wage revision was first raised.  He said that the common employees who are members of the affiliates of the Confederation deserve congratulations for the magnificent response to the call for the March to Parliament on 26th  July, 2012 and the subsequent one day strike action on 12th December, 2012.  He cautioned that the draft terms of reference prepared by the Staff Side would remain in paper if the same is not pursued by militant actions.  He told the participating members that the Confederation should not allow the setting up of the 7th CPC without a labour representative and must ensure that its Chairman is not one who is obsessed with the neo liberal economic reforms. He explained that the proposed struggle was not only for wage revision, though that being an important issue, but also to ensure that the neo liberal policies are not allowed to be pursued whoever comes to power. He reminded the comrades that the 15 point charter of demands include the important and significant issues like (a) withdrawal of the new contributory pension scheme, (b) stoppage  of contractorisation, outsourcing, privatization etc, (c) regularization of daily rated workers and GDS, (e) to bring the GDS within the ambit of the 7th CPC treating them as Civil servants, (f) revival of appointments on compassionate ground without conditions (g) filling up of vacant posts (h) functioning of the negotiating machinery and above all (i) arresting the ever rising prices of essential commodities.  He requested the members to appreciate the position explained and decide upon an inevitable strike action before the election process is begun.

Thereafter the house deliberated upon the proposal placed on behalf of the Secretariat.  Several Comrades took part in the discussions.  The decision to go on strike was welcomed by one and all. Some comrades forcefully pleaded that the Confederation must give a call for an indefinite strike action.  In the end, the house adopted a resolution indicating the following course of action to pursue the 15 point charter of demands.  (Full Text of the resolution, the press statement issued after the meeting, the details of the campaign programme at the National level will be placed on the website within a day or two).

(i)    Strike will be of 48 hours (2 days) duration.

(ii)   The two days strike will commence on 12th February, 2014 at 00 hours and will be concluded at 00 hours on 14th. i.e. Strike will be on 12th  and 13th February 2014.

(iii)       Strike notice will be served by the Confederation on Cabinet Secretary; all affiliates on their respective heads of Departments and copy of the same will be handed over to the respective heads of offices on 21st January, 2014. Prior to the serving of notice to the heads of offices, the unions will organize massive demonstration with cent per cent participation of members in front of all offices on 21.1.2014.

(iv)       Nationwide campaign will be organized covering all State Capitals and other important cities and towns in January, 2014.

(v)        State Committees will organize state wise campaigning programme covering all District Head Quarters in the first week of February 2014.

(vi)       Hold Press conferences; issue press statements and take steps to ensure media converge for the ensuing strike action.

The resolution received unanimous approval of the house, which was followed by thunderous slogan shouting.

Com. Secretary General then informed the house that the FNPO has agreed to synchronize their strike action for two days on the same dates and with the same charter of demands.

The house then took up the applications received from ARIES Employees Confederation (ARYABHATTA RESEARCH INSTITUTE OF OBSERVATIONAL SCIENCES) DEHRADUN and the DOT Employees Association of India, KOLKATA for grant of affiliation.  The house approved the proposal for the grant of affiliation to the two organizations.

Com. President before declaring the closure of the session requested the affiliates to take immediate steps to clear off the subscription dues for; lack of finance should not hinder the functioning of the CHQ.  Com. Parashar on behalf of the Secretariat had welcome the participants in the beginning.  Com. R. Seethalakshmi, Convener, Women Committee of the Confederation and the newly elected General Secretary of All India Postal Employees Union, Postmen and MTS/Group ‘D’ proposed vote of thanks.

CHARTER OF DEMANDS

1.      Accept the terms of reference of 7th CPC, submitted by the staff side, National Council JCM.

(a)      To examine the existing structure of pay, allowances and other benefits/facilities, retirement benefits like Pension, Gratuity, other terminal benefits of various categories of Central Government Employees including Gramin Dak Sevaks (GDS) of Postal Department.

(b)      To work out the comprehensive revised pay packet for the categories of Central Government employees including GDS as on 1.1.2014.

(c)       The Commission shall determine the pay structure, benefits, facilities, retirement benefits etc. taking into account the need to provide minimum wage with reference to the recommendation of the 15th Indian Labour Conference (1957) and the subsequent judicial pronouncement of the honorable Supreme Court there-on, as on 1.1.2014.

(d)      To determine the Interim Relief needed to be sanctioned immediately to the Central Government employees including GDS.

(e)       To determine the percentage of Dearness allowance/Dearness Relief immediately to be merged with Pay and pension including GDS.

(f)        To settle the anomalies raised in various fora of JCM.

(g)      To work out the improvements needed to the existing  retirement benefits, like pension, death cum retirement gratuity, family  pension and other terminal or recurring  benefits maintaining parity amongst past, present and future pensioners and family pensioners including those who entered service on or after 1.1.2004.

(h)      To recommend methods for providing cashless/hassle-free Medicare facilities to the employees and Pensioners including Postal pensioners.

2.      Ensure every five year revision of wages of Central Government Employees in future.

3.      (a) Regularisation of Gramin Dak Sevaks of the Postal Department and grant of Civil Servant status, statutory pension and all other benefits at par with regular employees.

(b) Regularisation and revision of wages of casual and contract workers.

4.      Compassionate appointment – removal of restrictions imposed by Government.

5.      JCM and Anomaly Committee Functioning.

6.      Fill up all vacant posts and creation of new posts wherever justified.

7.      Stop downsizing, outsourcing, contractorisation and privatization of Government functions.

8.      Stop the move to introduce performance related Pay (PRP) system, Extend PLB Bonus for all, removing bonus ceiling.

9.      Revise OTA and Night Duty Allowance rates and clothing rates.

10.  Implement arbitration awards.

11.  Five promotions to all.

12.  Rescind the PFRDA Act. Ensure statutory Pension for all.

13.  Stop price rise. Revive and extend public distribution system for all.

14.  Stop trade Union victimization.

15. Ensure Right to strike.
